LICENSE AGREEMENT
AND LIMITED LIABILITY STATEMENT
By using this software
you acknowledge that it's primary
purpose is to block access to certain
Internet sites, based on the possibility
that those sites contain material
which may be offensive or objectionable
according to the subjective standards
of LifeWayonline. As a result certain
sites may become unavailable to you
even though you may not deem the contents
of those sites either offensive or
objectionable. Also, LifeWayonline
cannot and does not guarantee that
all sites deemed offensive or objectionable
by you or any other person will be
blocked. LifeWayonline does not warrant
that the operation of the service
will be uninterrupted or error-free
or that any defects in the service
will be corrected.
LIMITATION
OF LIABILITY
LifeWayonline will not, under any
circumstance, be held liable for any
damages whatsoever, including any
special, indirect, incidental, consequential
or exemplary damages resulting from
the use or loss of use of the service,
due to any cause, even if LifeWayonline
has been advised of the possibility
of such damages. In any event, LifeWayonlines
total liability to you for all damages
(whether based on contract, torte,
or other theories) will be limited
to the amount you actually paid for
the service during the month in question.
Some states and jurisdictions do not
allow the limitation or exclusion
of liability for incidental or consequential
damages so the above limitation or
exclusion may not apply to you.
TERMS
OF AGREEMENT
If your check, draft, money order
or like instrument is tendered for
payment, and the instrument is dishonored
or returned unpaid for any reason,
we will charge and collect from you
a $40.00 fee plus the amount of the
check. The charge shall not be considered
an interest charge, a finance charge,
a time-price differential, or any
charge of a similar nature. The total
charge is payable from immediately
available funds.
LifeWayonline reserves
the right to charge a customer's credit
or bank debit card up to 10 days in
advance of their bill cycle date.
If a customer's card is declined LifeWayonline
will notify the customer by the e-mail
address included in our records. If
the credit card or bank debit card
information is not updated within
10 days of notice all accounts are
subject to suspension. Invoiced customers
will be sent an email if payment is
not received by the due date. All
invoiced accounts not paid by the
due date are considered past due and
are subject to suspension. It is the
customer's responsibility to notify
LifeWayonline if there are any changes
in the customer's account information,
i.e. phone numbers, addresses, changes
in credit card numbers, or changes
in expiration dates. If the customer
fails to notify LifeWayonline of changes
in their contact information it can
result in a temporary interruption
of service. The total amount due must
be paid before any account can be
reactivated. LifeWayonline reserves
the right to suspend any unpaid account
on these grounds. LifeWayonline will
not be held liable to pay or credit
any unused time as a result of suspension.
All services (i.e. designated email
addresses and or usernames) prior
to suspension or closure due to non-payment
may not be available upon re-activation.
Suspended accounts on our server for
60 days or longer will be removed
and the account will be cancelled.
Prices and packages
may be changed at any time. You will
be notified of the change by e-mail
at least 10 days prior to the next
billing cycle. It is the customer's
responsibility to ensure their e-mail
is functioning and to contact our
technical support department if it's
not. It is also the customer's responsibility
to read all e-mail sent by LifeWayonline's
staff and to respond as necessary.
It is the customer's
responsibility to contact LifeWayonline
as soon as they wish to cancel. All
cancellations must be made via telephone.
Emails and other forms of notice will
not be accepted. Cancellations will
always take effect on the account's
next bill cycle date. Cancellations
must be made by phone 10 days prior
to the accounts next bill cycle date.
Any costs accrued, as a result of
the customer's negligence to contact
LifeWayonline, will not be refunded.
LifeWayonline will not issue partial
credits or pro-rations for monthly-billed
accounts. New Quarterly and Yearly
billed accounts may be cancelled within
30 days of the sign-up date to receive
a refund. New Quarterly billed accounts
cancelled within the 30-day period
will be billed for one months service
without a discount and charged a $15.00
early termination fee. New Yearly
billed accounts cancelled within the
30 day period will also be billed
for one months service without a discount
and charged a $50.00 early termination
fee. All accounts cancelled after
the 30-day period will not be credited
for any unused service.
LifeWayonline customers
are responsible for all long distance
charges accrued by the customer, whether
through voice or data calls or consumer
negligence, such as not contacting
their phone company to ensure that
the phone number for LifeWayonline
access is local. It is LifeWayonline's
intent to have all customers accessing
the Internet through their service
via local phone lines. Any long distance
charges are the sole responsibility
of the customer.
WE
WANT YOU ON OUR TEAM
LifeWayonline will make every reasonable
effort to block offensive sites. New
sites are being added every day and
there is a possibility some sites
might not get detected by us right
away. At LifeWayonline we actively
encourage our customers to join us
in our efforts to provide the cleanest
Internet service available. If you
find a site that you believe should
be filtered, or maybe one we've filtered
you think shouldn't be, simply send
us an email including the web address
to sitepatrol@lwol.com.
Our site patrol review teams will
gladly review your submission and
respond to your request. Together,
we can keep the Internet a safer place
for all our members.
VIRTUALLY
UNLIMITED ACCESS
As an LifeWayonline customer, we
want you to have access to the Internet
without worrying about time restrictions.
That’s why we provide our customers
virtually unlimited Internet access.
This service allows any customer to
access the Internet up to 200 hours
per month. (That is an average of
6.5 hours a day.) The average LifeWayonline
customer accesses the Internet less
than 40 hours per month. Our virtually
unlimited access allows over 6 times
the average customer usage.
Internet access usage over 200 hours
in a 30-day period is considered "dedicated."
This is a service not currently provided
by LifeWayonline. If in any calendar
month your usage reaches the 200-hour
limit, your service will be temporarily
suspended until you contact LifeWayonline
to reopen that account.
LifeWayonline may also restrict the
amount of time you can stay continuously
connected to the Internet. A continuous
connection of approximately 4-hours
may be disconnected. This period may
be shortened depending on overall
network usage and other factors. A
connection that stays idle for a period
of 15 minutes may be disconnected
so that it will be available for other
users. If you are disconnected as
described herein, you will need to
redial in order to regain access to
the Internet.
To help ensure that all members have
access to LifeWayonline’s services,
members should not give out login
names and passwords to anyone. By
protecting your password, you will
help prevent unauthorized use of your
membership.
LifeWayonline monitors all accounts
for signs of unauthorized or unapproved
use and reserves the right to deactivate
your account if such use is detected.
Examples of this include spamming
newsgroups, sending unsolicited e-mail
to LifeWayonline or other Internet
mailboxes, simultaneous logins, reselling
the service, illegally distributing
copyrighted software and/or other
material that causes an abuse of bandwidth.
LifeWayonline reserves the right
to contact any customer regarding
information pertaining to their user
accounts.
